Welcome to MyKiddos. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and APB Digital Office SRL ("we," "us," or "our"), concerning your access to and use of the MyKiddos mobile application and its related services (collectively, the "Service").
By creating an account or using our Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.
MyKiddos provides parents and legal guardians with tools to track and manage their children's health information. The Service allows you to log data such as illnesses, symptoms, medications, appointments, and immunizations in a single, secure location. Features may also include the ability to share specific health information with third parties, such as physicians or other caregivers, at your sole discretion.
MYKIDDOS IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The Service is intended for informational and organizational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked on the MyKiddos application.
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
Age Requirement: You must be at least 18 years old to create an account.
MyKiddos offers a free tier of service ("MyKiddos Basic") and a subscription-based tier ("MyKiddos Plus") which provides access to premium features. The features available in each tier are described within the application.
Subscriptions to MyKiddos Plus can be purchased on a monthly, semi-annual, or annual basis. Payments are processed through the third-party platform from which you downloaded the application (e.g., the Apple App Store or Google Play Store).
Auto-Renewal Notice:
Your subscription will automatically renew at the end of each billing cycle unless you cancel it. You can manage and cancel your subscriptions through your app store account settings.
We may offer a free trial period for new users of MyKiddos Plus. If you do not cancel before the end of the free trial period, you will be automatically charged for the subscription plan you selected upon registration.
We reserve the right to change our subscription plans or adjust pricing for our Service in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following email notice to you.
You are the sole owner of the information you enter into the Service, including all sensitive health data about your children ("User Content"). You are solely responsible for the accuracy, quality, and legality of your User Content. You grant us a limited, worldwide, non-exclusive license to host, process, and display your User Content solely for the purpose of providing and maintaining the Service for you.
Parental Authority:
You warrant that you are the parent or legal guardian of any child whose information you provide, and that you have the legal authority to manage and share this information.
You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of APB Digital Office SRL and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You may terminate your account at any time by discontinuing use of the Service or by using the account deletion feature within the application.
To the maximum extent permitted by applicable law, in no event shall APB Digital Office SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
